District Court Cases in Stearns

In the Minnesota system, the district court is a court of general jurisdiction, so it hears both serious crimes and civil cases with any claim amount, as well as appeals from conciliation court. A criminal case is initiated by the County Attorney; currently, this position is held by Janelle Kendall, whose office maintains a criminal case search database.

Cases are distributed among the judges of the Seventh Judicial District. After an indictment or civil complaint is filed, a judge is assigned to handle the case from start to finish, including preliminary hearings, motion hearings, and trial. Appeals from conciliation court decisions also go to the district court for a trial de novo.

Magistrate Court Cases in Stearns

Minnesota does not have a separate magistrate court system. Instead, there is a conciliation court, which functions as a division of the district court and hears small civil claims.

The claim limit for conciliation court in Minnesota is $15,000. Traffic violations, misdemeanors, petty misdemeanors, and preliminary hearings in felony cases are all heard by the district court. DUI/DWI cases begin with an arraignment and go through the same system. A referee or district court judge may handle specific categories of cases depending on the court's workload.

Family Law, Probate, and Juvenile Matters in Stearns

Family Law. Divorce, child custody, child support, protective orders, paternity establishment, and termination of parental rights are all handled by the district court. Divorce forms are available on the Minnesota Judicial Branch page. Certified copies of divorce decrees can be obtained from the courthouse in the county where the decree was issued. Access to family case materials may be restricted according to Minnesota Rules of Court—more details on the Court Records Research page.

Probate Cases. The probate division of the district court handles estate administration, appointment of guardians and conservators, and trust matters. Documents are filed through the district court office.

Juvenile Matters. Juvenile court is part of the district court. Juvenile records are confidential under Minnesota law. Information about juveniles in sheriff custody is restricted by state law.

How Cases Move Through the Stearns Court System

  1. Case Initiation. A criminal case begins with the filing of a criminal complaint by the prosecutor. A civil case starts with the filing of a civil complaint or petition in family or probate matters.
  2. Judge Assignment. The court office assigns the case to a judge of the Seventh Judicial District.
  3. First Hearing. In criminal cases, this is the arraignment, where charges are announced and bail is set. In civil cases, it's a scheduling conference to set the timeline.
  4. Pre-Trial Phase. Parties exchange evidence (discovery), file motions. In criminal cases, plea negotiations may occur.
  5. Trial or Resolution. The case concludes with a trial, settlement, guilty plea, or default judgment.
  6. Post-Judgment. Criminal cases move to sentencing. Any party may appeal to the Minnesota Court of Appeals. In civil cases, judgment enforcement is possible.
